Terms of Service for ISTQB Foundation Exam

1. Acceptance of Terms

By downloading, installing, or using the ISTQB Foundation Exam mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

ISTQB Foundation Exam is a mobile application designed to help users prepare for the ISTQB Foundation Level certification exam through:

Practice questions organized by domain/topic
Flashcards for memorization and review
Practice tests and real exam simulations
Study plan generation and progress tracking
Premium features via in-app subscription

3. Eligibility

Age Requirement: You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use this App.

Parental Consent: If you are under 18, you must have your parent or legal guardian’s permission to use the App and make purchases.

Accuracy: You represent that all information you provide is accurate and current.

4. User Account

Device-Based Account: Your account is tied to your device via a unique identifier. No email or password is required.

Account Security: You are responsible for maintaining the security of your device and account.

Prohibited Activities: You may not:

Share your account with others
Attempt to access another user’s account
Use automated tools (bots) to interact with the App
Reverse engineer, decompile, or disassemble the App

5. Subscriptions and Payments

5.1 Subscription Plans

We offer the following subscription plans:

Weekly Subscription: Billed every 7 days
Monthly Subscription: Billed every 30 days

Pricing: Current prices are displayed in the App and may vary by region.

5.2 Billing

All subscriptions are processed through Apple App Store
You will be charged through your Apple ID account
Payment will be charged upon purchase confirmation
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

5.3 Free Trial (if applicable)

Some subscription plans may include a free trial period
You must cancel before the trial ends to avoid being charged
Trial availability and duration may vary

5.4 Cancellation

How to Cancel:

Open iOS Settings
Tap your name → Subscriptions
Select ISTQB Foundation Exam
Tap “Cancel Subscription”

Effect of Cancellation:

You will retain premium access until the end of your current billing period
No refund will be issued for the unused portion of your subscription
Your progress and data will be preserved

5.5 Refunds

All sales are final
Refund requests must be made through Apple App Store
We do not have the ability to process refunds directly

6. Premium Features

Premium subscription includes:

Unlimited access to all practice tests
All real exam simulation tests
All flashcards across all domains
Detailed explanations for all questions
Ad-free experience (if applicable)
Priority customer support

Free Features:

Limited practice tests (first 2 tests)
Limited real exam tests (first 1 test)
All question explanations in free tests
Basic progress tracking

7. Content and Intellectual Property

7.1 Our Rights

All content in the App, including but not limited to:

Questions, explanations, and study materials
Text, graphics, logos, icons, images
Software, code, and algorithms
Study plans and flashcards

is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Use the App for personal, non-commercial purposes
Access content you’ve unlocked (free or premium)

You May NOT:

Copy, reproduce, or distribute App content
Create derivative works based on the App
Use content for commercial purposes
Share premium content with non-subscribers
Scrape, data mine, or extract content in bulk

7.3 Trademarks

“ISTQB Foundation Exam” and related logos are our trademarks. You may not use them without our written permission.

8. Content Accuracy and Disclaimers

8.1 No Guarantee of Passing

This App is a study aid, not a guarantee of exam success
Actual exam content may differ from our practice questions
We do not have access to official ISTQB exam questions
Exam format, difficulty, and topics may change

8.2 Educational Purpose Only

Content is provided for educational purposes
We strive for accuracy but cannot guarantee 100% correctness
Always verify information with official ISTQB materials
Exam policies are subject to change by ISTQB

8.3 No Warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE PAST 12 MONTHS
WE ARE NOT LIABLE FOR EXAM FAILURE, LOST TIME, OR MISSED OPPORTUNITIES

Exceptions: Nothing in these Terms limits liability for fraud, gross negligence, or death/personal injury caused by our negligence.

10. User Conduct

You agree to use the App in compliance with all applicable laws and these Terms.

Prohibited Activities:

Harassing, abusing, or harming others
Posting illegal, offensive, or infringing content
Attempting to hack, disrupt, or damage the App
Using the App for unauthorized commercial purposes
Sharing copyrighted content without permission
Creating multiple accounts to circumvent limitations

Consequences: Violation may result in account suspension or termination without refund.

11. Third-Party Services

The App uses third-party services:

Apple App Store: For app distribution and payments (governed by Apple’s Terms)
RevenueCat: For subscription management (https://www.revenuecat.com/terms)
Supabase: For data storage (https://supabase.com/terms)

You agree to comply with their terms of service as well.

12. Updates and Changes

12.1 App Updates

We may release updates to fix bugs, add features, or improve performance
Some updates may be required to continue using the App
Updates may change or remove features with or without notice

12.2 Terms Changes

We may modify these Terms at any time
Changes will be effective upon posting in the App
Continued use after changes constitutes acceptance
Material changes will be announced via in-app notification

13. Termination

13.1 Termination by You

You may stop using the App at any time by:

Deleting the App from your device
Cancelling your subscription (see Section 5.4)

13.2 Termination by Us

We may suspend or terminate your access if you:

Violate these Terms
Engage in fraudulent activity
Abuse the subscription system
Use the App for illegal purposes

Effect: Upon termination, your license ends immediately. Subscriptions are non-refundable.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a legal claim, contact us at support@istqbexamapp.com to resolve the dispute informally. We will attempt to resolve within 30 days.

14.2 Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

Jurisdiction: You agree to submit to the jurisdiction of courts in California, United States.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 No Waiver

Our failure to enforce a right does not waive that right.

15.4 Assignment

You may not assign these Terms. We may assign them to a successor or affiliate.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, strikes).

17.1 Apple Requirements

These Terms are between you and us, not Apple
Apple is not responsible for the App or its content
Apple has no warranty obligations

Apple is not liable for any claims related to the App
You must comply with Apple’s App Store Terms of Service

17.2 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

By using ISTQB Foundation Exam, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
